"In relation to this disaster, the formal complaint of the very serious non-fulfillment of this Company to the maintenance obligations (ordinary and extraordinary) and custody, in objective consideration of the collapse of the infrastructure, of the confirmed victims and of the considerable damage reported to assets also of third parties, without considering the interruption of the road system and therefore the compromise of the functionality of the infrastructures granted.

Following the dispute in question, and the outcome of the evaluation of the counter-arguments that this Company will send, it reserves the right to carry out all the protection initiatives set up by the legal system, without prejudice to the suitability of the present to activate the procedures referred to to articles 8, 9 and 9-bis of the concession agreement.

Considering the nature and characteristics of the event that has occurred and the widespread social alarm that is deriving from it, it reserves the right to submit to the competent Government Authorities any evaluation in order to best satisfy the many public interests involved, which pertain to the plan for the protection of life, health and safety of citizens and infrastructure users.

In light of the specific powers and duties falling on this Company pursuant to art. 14 of the Highway Code as well as the obligations related to the management and maintenance of the motorway defined by the concession agreement, it is requested to send the undersigned General Management, within 15 days from today's date, a detailed report in which clear evidence of all the fulfilments put in place to ensure the functionality of the infrastructure in question and prevent the specific event that occurred, with annexed any act put in place in order to guarantee the maintenance of the functionality of the infrastructure and aimed at preventing the collapse that actually occurred.

Without prejudice, in the event of the concessionaire's ascertained responsibility, all full protection with regard to damages and prejudices deriving from contractual non-fulfillment, we are waiting to evaluate the compensation initiatives also in specific form for the pecuniary and non-pecuniary damages that this Company will deem to formulate ".
